Understanding F-1 OPT & STEM Unemployment Rules

Under Department of Homeland Security (DHS) regulations, international students on Post-Completion Optional Practical Training are granted a limited allotment of cumulative unemployment days to find qualifying employment directly related to their major area of study.

Initial 12-Month Post-Completion OPT

  • Maximum Limit: Exactly 90 cumulative calendar days (8 CFR § 214.2(f)(10)(ii)(E)).
  • Day 1: Begins counting on the approved EAD start date, not graduation day.
  • Weekends & Holidays: Every calendar day counts if you are not actively employed.
  • Permitted Work: Paid, unpaid internships, volunteering, and self-employment (≥ 20 hrs/week).

24-Month STEM OPT Extension

  • Maximum Limit: 150 cumulative calendar days total (90 initial + 60 additional under USCIS STEM rules).
  • Rollover Days: Any unemployment days used during initial OPT count toward the 150 limit.
  • Strict Requirement: Must be paid employment with an enrolled E-Verify employer.
  • Volunteering Prohibited: Volunteer work does NOT count on STEM OPT.

Does the EAD Start Date Count as Day 1 of Unemployment?

Yes. Under official SEVP policy guidance, the unemployment clock begins counting on the approved "Valid From" start date printed on your Form I-766 EAD card. If your job start date is subsequent to your EAD start date, every intervening calendar day accrues toward your 90-day allotment.

What Happens If You Reach 90 Days of Unemployment?

If you exceed the 90-day maximum without reported qualifying employment, your SEVIS record is subject to automated termination by SEVP. Unlike normal graduation or program completion, students whose records are terminated for exceeding unemployment limits do not receive a 60-day grace period and must immediately transfer their SEVIS record, file for a change of status, or depart the United States.

Frequently Asked Questions

Does the EAD start date count as Day 1 of OPT unemployment?

Yes. Under official SEVP policy guidance, the unemployment clock officially begins on the approved “Valid From” start date printed on your Form I-766 EAD card. If you do not have qualifying employment on that day, it counts as your first day of unemployment.

Do weekends and federal holidays count towards OPT unemployment?

Yes. SEVP counts consecutive calendar days, not business days. Any weekend or federal holiday that falls in an active unemployment period counts against your cumulative 90-day or 150-day limit.

How many unemployment days are allowed on STEM OPT?

Students approved for the 24-month STEM OPT extension receive an additional 60 days of unemployment, for a cumulative total of 150 days across their entire practical training period. Unused days from your initial 12-month OPT roll over into the 150-day STEM limit.

Can I volunteer to stop the OPT unemployment clock?

On initial 12-month post-completion OPT, volunteer or unpaid work of at least 20 hours per week directly related to your major field of study pauses the unemployment clock. However, on the 24-month STEM extension, volunteer work is strictly prohibited—all qualifying employment must be paid with an enrolled E-Verify employer.

What happens if you reach 90 days of unemployment on OPT?

If you exceed the 90-day limit without reported qualifying employment, your SEVIS record is subject to automated termination by SEVP. Students terminated for unemployment do not receive a 60-day grace period and must immediately transfer their SEVIS record to a new school, apply for a change of status, or depart the United States.

Where does SEVP show my official unemployment day count?

Your official unemployment day balance is recorded in the SEVIS database. You can view your reported employment intervals by logging into the official SEVP Portal (sevp.ice.gov), or by requesting an updated Form I-20 and SEVIS status printout from your university Designated School Official (DSO).
